You have the absolute right to convert from one chapter to another chapter and avoid dismissal of your case.  In order to convert your case, you or your bankruptcy lawyer must file a motion to convert. Sometimes the trustee will file a motion to convert your case to a chapter 7 if he/she believes that your case is inappropriate. To convert your case, simply follow the three (3) easy steps below.

STEP #1:

1. Download the PDF Form

NOTICE OF CONVERSION - (THIS IS THE ACTUAL LEGAL NOTICE)

STEP #2

2. DOWNLOAD THE MOTION

STEP #3:

3.  DOWNLOAD THE ORDER GRANDING MOTION

4.  SERVE ALL PARTIES AND THE TRUSTEE WITH

A PROOF OF SERVICES OF THE MOTION.

NOTE:  YOU MUST GIVE A COURTESY COPY THE THE JUDGE

BY DROPPING OFF A COPY OF YOUR MOTION AT THE JUDGES

CHAMBERS. (LOCAL RULES)

NOW YOU CAN JUST KICK BACK AND SEE IF THE JUDGE ALLOWS THE CONVERSION.  IF THE CONVERSION IS NOT DONE IN BAD FAITH, THEN

YOU SHOULD RECEIVE THE ORDER CONVERTING THE CASE.

YOU MAY NEED TO PAY EXTRA FEES DEPENDNG ON WHAT CHAPTER YOU ARE CONERTING TO.
