You don't have to go to trial to beat your adversary. In fact, Summary Judgment is preferred by the courts in order to avoid an unnecesary trial. Simply Compose a Motion for Summary Judgment if you evidence, and they file with your motion with the Court. If you are denied, you can always appeal it. However, it is always a good thing to move for Summary Judgment if you believe you have sufficent evidence to support your case. Having a "Perry Mason" drama case in Court is really NOT necessary, and most cases are resolved on Summary Judgment.
